General Terms and Conditions
Last updated: October 18, 2026
These General Terms and Conditions ("Terms") govern the use of the Bitpayway payment gateway, operated by Bitpayway ("Bitpayway", "we", "us"). The service includes the dashboard, the API, the webhooks, the checkout and the smart contracts that settle payments (together, the "Service").
By creating an account or using the Service, you accept these Terms and the Privacy Policy. If you use the Service on behalf of a company, you confirm that you have the authority to bind it to these Terms.
Definitions
- Client or you: the person or business that creates an account and receives payments through the Service.
- Payer: a customer of a client who pays an order in the checkout.
- Partner: a person or business that receives part of a multi-destination payment.
- Order: a payment request created by the client's application through the API.
- Settlement wallet: the wallet address the client registers to receive payments of each stablecoin on each network.
The Service
Bitpayway lets businesses receive stablecoin payments directly in their own wallets. With the Service, you can create businesses, generate API keys, create orders, redirect payers to the checkout, receive webhook notifications and follow orders in the dashboard. The stablecoins, networks and token contracts accepted are listed in the documentation.
Non-custodial settlement
- Payments are settled by smart contracts. In the same transaction, the platform fee goes to Bitpayway and the rest of the amount goes from the payer's wallet directly to your settlement wallet. Bitpayway does not hold, manage or invest your funds.
- Only you control your wallets. We never have access to your private keys or recovery phrases, and we cannot move, freeze or recover the funds in your wallet.
- Blockchain transactions are final. Bitpayway cannot cancel or reverse a payment. Refunds to payers are your responsibility and are made from your own wallet.
Your account
- You must be at least 18 years old and legally able to enter into contracts.
- Provide accurate information and keep your email address up to date. We use it to send you service communications.
- Keep your password, API keys and webhook secret key confidential. You are responsible for all activity carried out with them. If you suspect a key has been exposed, revoke it, create a new one and tell us right away.
- Bitpayway does not verify the identity of its clients. This does not release you from any legal obligation. We may ask for information about you and your business at any time, and we may suspend the account if it is not provided or if it is inconsistent.
Your responsibilities
- Settlement wallets: register only addresses that you control and that can receive the stablecoin on the selected network, and check each address before enabling it. Payments are sent to the wallet registered when the payment is made. Bitpayway is not responsible for funds sent to a wrong address that you registered, which may be lost.
- Wallet security: you are responsible for the security of your wallets, including their private keys, recovery phrases and devices.
- Integration: verify the signature of every webhook with your webhook secret key, and confirm the payment status through the webhook or the API. The browser redirect is not proof of payment. Losses caused by an integration that does not follow the documentation are your responsibility.
- Your business: you are solely responsible for the goods and services you sell and for their delivery, prices, refunds, customer service, tax obligations and invoices. You must comply with the laws that apply to your activity, including consumer protection, anti-money laundering and sanctions laws. The purchase is a relationship between you and the payer, and Bitpayway is not a party to it.
- Partners: in multi-destination payments, you are responsible for your agreements with partners, for the share defined in each order and for the partner wallet addresses you register.
- Personal data: you are responsible for the data you send us about payers and partners, as described in the Privacy Policy.
Prohibited uses
You must not use the Service to:
- sell goods or services that are illegal where you or the payer are located;
- launder money, finance terrorism, evade sanctions, or transact with sanctioned persons or jurisdictions;
- defraud or deceive payers, including through pyramid schemes, scams and fraudulent investment offers;
- offer gambling, betting or lotteries without the licenses required by law;
- infringe intellectual property or other rights of third parties;
- receive payments on behalf of third parties without our prior written consent;
- attack, overload or reverse engineer the Service, test its vulnerabilities without authorization, or access accounts or data of other people.
If you find a vulnerability, report it to [email protected].
Fees
- Bitpayway charges a platform fee on each payment, as a percentage of the gross amount paid. The fee is deducted on-chain in the payment transaction, at the rates listed on the Fees page. There are no monthly, setup or withdrawal fees.
- Network costs of the transaction (gas) are paid by the payer and are not part of the platform fee.
- We may change the fees. We will announce an increase on the Fees page and by email at least 30 days before it takes effect. A reduction may take effect immediately. The new rate applies to payments made after it takes effect.
Networks, tokens and availability
- The Service depends on blockchain networks, token issuers, wallets and infrastructure providers that Bitpayway does not control. Network congestion, high network costs, network failures and decisions of token issuers, including freezing wallet addresses, may delay, prevent or affect payments.
- Only payments made through the checkout, with the official token contracts listed in the documentation, are recognized as payment of an order. Tokens sent in any other way, including bridged tokens or direct transfers to a wallet, are not recognized, and Bitpayway cannot recover or redirect them.
- We may pause the payment smart contracts to protect users, for example in response to a security incident. While they are paused, no new payments are accepted. Funds already received in your wallet are not affected.
- We work to keep the Service available, but it may be interrupted by maintenance, failures or events beyond our control. We may add, change or discontinue networks, tokens or features, and we will give prior notice when the change affects your integration.
Payers
If you pay an order in the checkout:
- you are buying from the client that created the order. Questions about the purchase, its delivery and refunds must be sent to that client;
- check the network, the stablecoin and the amount before confirming the transaction in your wallet. Network costs (gas) are paid by you;
- your payment cannot be cancelled or reversed by Bitpayway;
- if the order expires before your transaction is confirmed, the transaction fails and the amount is not transferred, but network costs may still be charged by the network.
Suspension and termination
- You may stop using the Service at any time. You can delete your businesses in the dashboard, and you can close your account by writing to [email protected].
- We may suspend or block your account, revoke your API keys or terminate these Terms if you breach them, if we suspect fraud or illegal use, if required by law or by a competent authority, or to protect payers, partners or the Service. When the law allows and there is no urgency, we will tell you the reason.
- Termination does not affect payments already settled on the blockchain, which remain in your wallet.
Intellectual property
The Bitpayway brand, software, dashboard, checkout and documentation belong to Bitpayway or to its licensors. We grant you a limited, non-exclusive, non-transferable and revocable license to use the Service and the documentation to integrate your applications while these Terms are in force.
Limitation of liability
To the extent permitted by law:
- the Service is provided "as is" and "as available", with no warranties other than those expressly stated in these Terms;
- Bitpayway is not liable for losses caused by wrong wallet addresses, by exposed keys or passwords, by your integration, by blockchain networks, token issuers, wallets or other third parties, by changes in the value of tokens or by events beyond its reasonable control;
- Bitpayway is not liable for loss of profits, loss of business or indirect damages;
- the total liability of Bitpayway to you is limited to the platform fees it received from your payments in the 12 months before the event that gave rise to the claim.
Nothing in these Terms limits liability that cannot be limited under applicable law, including mandatory consumer protection rules.
Indemnification
You agree to indemnify Bitpayway against claims by third parties, including payers, partners and authorities, arising from your business, your breach of these Terms or your breach of the law.
Changes to these Terms
We may update these Terms. We will change the date at the top of this page and notify clients by email at least 30 days before significant changes take effect. If you continue to use the Service after that, you accept the new Terms.
General provisions
- These Terms, the Privacy Policy and the documentation form the entire agreement between you and Bitpayway about the Service.
- If a provision is held invalid, the other provisions remain in force.
- If we do not enforce a provision, we do not waive the right to enforce it later.
- You may not transfer your rights under these Terms without our consent. We may transfer ours as part of a merger, acquisition or reorganization.
- We send notices to the email address of your account. Send notices to us at [email protected].
- These Terms are available in English and Portuguese. If the versions differ, the Portuguese version prevails.
Governing law and disputes
These Terms are governed by the laws of the Federative Republic of Brazil. Before going to court, contact us so that we can try to resolve the matter amicably. Disputes will be settled by the competent courts in Brazil, without prejudice to mandatory rules that grant a different venue to consumers.
